7. Right of withdrawal
The Customer has the right to withdraw from the purchase contract for any reason, without explanation and without penalty, except in the cases of exclusion provided for in point IV below. To exercise this right, the customer must send Kucino a communication within 14 days from the date of receipt of the Products or, if the customer intends to exercise the right of withdrawal before receiving the Products, the withdrawal notice may be sent at any time before receipt.
This communication must be sent by registered letter and/or fax, addressed to:
C.A.
Kucino of Roushdy Farag Emile
Viale Nizza 11
67100 L'Aquila (AQ)
Subject: Returns/Refunds
The Customer Service of Kucino will provide, once received the communication, to open a file for the management of the return and to communicate to the customer the instructions on how to return the products, which will be via courier indicated by Kucino itself.
The right of withdrawal is governed by the following conditions:
I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the right of withdrawal only on part of the Product purchased.
II. In case of exercise of the right of withdrawal, Kucino will refund the customer the full amount of the returned goods, including shipping costs where applicable, without prejudice to the right of Kucino to suspend the payment of the refund until the actual receipt of the goods. The refund will be made in the manner described in paragraph 5.2 of these General Conditions.
III. Also in order to ensure that the return is free of charge in accordance with Article 8 below, the Products must be returned in the same box in which they were received.
IV. In addition to the cases indicated in the Foreword (non-consumer customer and/or customer requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree 21/2014:
- order of Products made to measure or clearly customised;
- order of Products that are likely to deteriorate or expire rapidly;
- orders for sealed Products that are not suitable to be returned for hygienic or health protection reasons or that have been opened after delivery.
With reference to the cases of exclusion of the right of withdrawal listed above, the Customer, in particular, is informed and accepts that these include all food products (including wines, spirits and beverages), as the characteristics and qualities of these types of products are subject to alteration also as a result of improper storage. Therefore, for reasons of hygiene and protection of Customers, the right of withdrawal is applicable only to Products purchased on the Site that can be returned to Kucino and put back on the market without risk to the health of consumers.
8. Cancellation, postponement or change of shipping address of the order
The Customer may cancel, postpone or request a change of shipping address of the order within a period of two hours. After this period, the order will be processed and it will no longer be possible to request cancellation or change of shipping address.
The customer must contact Customer Service directly from the website using the contact form available in the Customer Service area.
Kucino reserves the right to cancel the order in case of unforeseeable difficulties, informing the Customer by email, or, subject to agreement with the same, change the day and/or time of delivery.
9. Warranty and Conformity Defects
In the event of a lack of conformity of Products sold by Kucino, the Customer must immediately contact Customer Service using the contact form available in the CONTACT US section of the website. The legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right, at his or her choice and provided that the type of Product allows it, to have the conformity of the Product restored, free of charge, by means of replacement, or to an appropriate price reduction or to terminate the contract.
The customer loses these rights if he does not report the lack of conformity to Kucino within two months from the date on which he discovered the defect, unless it is a Product that by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within this reduced period.
